What is a legal document assistant (LDA)?
An LDA is an experienced professional who is authorized to prepare legal documents for a client, but only at the direction of the client. In other words, an LDA is there to assist the “self-help” client handle their own legal matters without the cost of an attorney. Since even the best legal, self-help books can be confusing and overwhelming, your LDA can provide invaluable assistance with routine legal tasks, such as typing and filing the paperwork for uncontested divorces, bankruptcies, wills, and many other types of documents.
Can an LDA give legal advice?
An LDA is forbidden to practice law of any sort, they cannot make suggestions as to what the client needs done for a particular matter, or what forms that the client must file with the state or the other party to the action.
What is a notary public?
A notary public is an authorized public officer who acts as an impartial witness in the notarization of important documents. Their role is to verify the identity of the signatories, ensure the willingness and understanding of the parties involved, and administer oaths or affirmations when necessary.
Can a notary public provide legal advice?
No, a notary public or document assistant are not authorized to provide legal advice or guidance regarding the content or implications of the documents being notarized or filled out. If you need legal advice, you must seek an attorney. Notary public's role is strictly limited to verifying identities, ensuring willingness, and notarizing signatures.
What is a criminal expungement?
An expungement essentially changes the disposition of the case to reflect a dismissal under Penal Code 1203.4. Petitioner shall be permitted by the court to withdraw his or her plea of guilty or plea of nolo contendere and enter a plea of not guilty; or, if he or she has been convicted after a plea of not guilty, the court shall set aside the verdict of guilty; and, in either case, the court shall thereupon dismiss the accusations or information against the defendant and except as noted below, he or she shall thereafter be released from all penalties and disabilities resulting from the offense of which he or she has been convicted.
How long does it take to reflect the expungement?
The California Department of Justice database, which is where your official California rap sheet comes from, will be updated automatically by the court following your expungement, and must be done within 30 days. At the county superior court system level, the court website, and the court's internal records, are often updated the same day the expungement is granted by the judge.
